1 posts Posted 19 January 2014 - 01:59 PM I recently took FMLA and filed all the necessary paperwork with HR. Emailed my boss and was approved and had approved time cards signed for my personal leave for my wife's birth of our first son. While still at the hospital, my supervisor texted me saying I did not keep him in the loop and threatened to write me up while Im Still in the hospital caring for my wife and son. I asked him by text to leave me alone since I have to focus on my son and wife. ( tests were being done on my new born and my wife was in terrible pain) he continued to text me I will have paper work for being non compliant when I return. I was very upset and distraught and still am over this issue and it has taken away from the best days of my life. I had to deal with incompetence and mood swings from managerial staff, and give negative energy to my family rather then enjoying my most prized day.Do you think this classifies as harassment and do I have a case? When I asked to talk with him he said the paperwork was dropped but the damage has already been done and I'm very upset. It sounds more like a case of miscommunication in that your supervisor evidently wasn?t aware that you?d followed all the procedures to take the FMLA leave. In any event, you appear to have no damages for which to sue over this. Being upset by itself is not something for which the law compensates you.
